The Board members sit as a three-member court known as the Appellate Division. In any claim where a final decision has been issued by an administrative law judge, either party may file a written appeal with the Appellate Division within 20 days of such decision. Each year, the Appellate Division receives over 900 appeals a year. For specific procedures, please refer to O.C.G.A. §34-9-103 and Board Rule 103. An appeal may be filed at the following address:

When an appeal is filed, either party may request oral argument before the Appellate Division. When such request is made, an oral argument date will be set within 60 days of the filing of an appeal. Oral argument is limited to five minutes for each side unless extend by permission.
After oral argument or when no oral argument is requested, the Appellate Division will consider the record plus the arguments presented by the parties. After consideration of the record and the arguments presented by the parties, the Appellate Division will issue a decision. Currently, the Appellate Division issues decisions, on average, in less than 60 days from the date of oral argument or when an appeal is submitted for review. During calendar year 2003, the Appellate Division issued over 900 decisions.
